    If you do a little more reading you'll find that the injuries described there weren't the older fellow on the Triumph Thunderbird, but another rider who lost control of his bike about an hour after that first accident. He apparently hit the fluids left on the road. That rider went off into the trees and is the one who suffered the bad injuries. The older fellow is suffering from minor injuries to his arm.

    We do act differently when we are under observation though; ever change your walk, puff out your chest when someone starts staring at you? How about when the car behind you is a LEO? It's not 100% blame but it is a factor.

    Wait, someone starring at you is responsible for YOUR actions because YOU change your actions when you start staring at them?

    I know I'm one of the ones that beats the personal responsibility drum a lot around here. But surely we can all agree about where the buck stops in this instance!

    Yep. It's the photographer and driver of the vette who caused this problem.

    I just include the driver of the vette as on another discussion I've been having about this there are a couple guys who keep saying how much responsibility Killboy has in this (even though it isn't killboy taking the pictures) . If you're going to be silly at least do it well.

    As a parent of two teenagers I certainly support personal responsibility in a person's actions. In spite of this, I fnd the parallel to quantum mechanics and Schrödinger's cat to be surprising. As Father Ribs says, the observer, just by observing, can affect the outcome. Again, I am not saying the observer is responsible for the situation but they are a factor.

    Yes, but in Schrödinger's argument, the outcome of the experiment depends on the observer, but it doesn't depend on the observer being observed. In this case Triumph Guy's behavior changes because he knows that there is an observer, which is, IMO, different than Schrödinger's argument.

    Indeed, if photo guy wasn't there, it is unlikely that Triumph Guy would have been waving to the trees. Photo guy did impact the overall outcome, but responsibility lies with Triumph Guy.

    What about the personal responsibility of the person who crashed because of the puddle of oil this guy laid down? I wonder if he bears the same burden of personal responsibility regardless of the circumstances of what came before him and whether he actually had knowledge of it. It was his personal responsibility to ride safely, thus one cannot attribute his crashing to the waving guys failure to pay attention to his surroundings.

    And if that were the case, it makes the post about the other rider crashing completely irrelevant, except as a good example of cause and effect.

    Exceeding safe speed for the road conditions. Each of us is responsible for riding at a speed to accommodate for any and all potential road hazards, including oil in the public road. Some Most of us consciously exceed that safe speed on a regular basis as a calculated risk. We know there probably isn't any oil in the next corner. But if there is, we are personally responsible for the outcome as we willingly assumed those risks.

    That's how I see it anyway.

    Don't get me wrong. I would still hold this ass-hat morally responsible. However I do not agree that he is legally responsible. And by absolutely no means do I find fault in the guy with the camera.
