So, to codify your argument, there are a lot of lawsuits and lawyers are not good because lawyers look to get "PAID" for their services. Got it. Oh, and lawyers serve no other purpose but their own greed. Got it. Whew, and to think, I thought I wasn't going to learn anything today.![]()

I guess that qualifies me to take the LSAT's and maybe sit for the Bar exam some day?
Not really, it just would have taken a lot more time to address those arguments I thought completely lacked any merit.I felt it more expediant to strip it down to the only parts that made sense.

Yup . . . but I'm the good kind (and no, I'm not dead). Damn, they forgot to mention I'm admitted to the Connecticut Bar, the United States District Court for the District of Connecticut, United States District Court for the Southern District of New York and the Second Circuit Court of Appeals. Oh, and Judge Schaller now sits on the Connecticut Supreme Court. Jeeze, I better read these things once in a while.

and for what its worth, i did not assume. i made a logical deduction based on your obvious pre-existing bias, your familiarity with certain terminology and your pointed approach to the argument.
I suspect from your very first post that you were an attorney, largely because almost no one ever defends attorneys.
and, as it turns out i was right..
though you were urging us to assume that the facility was negligent from the get-go..

I defend attorneys all the time. My mom started law school when I was 9 and spent several years working as a public defender. That's not the kind of job you can do without a real appreciation for the fact that all of the moving pieces of the justice system have to be functioning to make it work.
And besides, if no one ever sued for silly shit there wouldn't be a warning on my curling iron that says, and I quote "Do not insert in vaginal opening." I giggle every time I read it.

Personally, I despise personal injury law. I do not and will not practice in this area of law. If a complex issue arises from such matters, then I get more interested, but only on that limited basis. One such instance was a wrongful death case that I recently argued before the Connecticut Supreme Court back in October. I'm more of an appellate/academic type of an attorney rather than a slip and fall type of an attorney which is why my practice is more focused on complex commercial litigation and appellate matters. I love the study of law.
I tried to share some of my perspective on this issue along the way. There are many different theories behind tort law. While I understand the conclusion and the court’s reasoning, I am somewhat troubled by the decision and am very interested to see what the Florida Supreme Court and the Florida Legislature does (if anything) to stem the “slippery slope arguments” afterwards.
