Derek,
You had promised to have the band stop at 9:30PM before the 10PM noise
curfew. I understand that everyone at the party was having a good time but
we got complaints from the folks that were trying to sleep, some of them had
young kids with them.
They were pretty reasonable. At 9:35 they said "what the heck perhaps they
started late" at 10:01 they said "perhaps they are doing just one more" at
10:15 they were mad.
It is important that you keep your word in these situations. It may be
difficult for you to get permission for another party at NHIS. You came
close to getting a police escort off the property.
Sorry to have to tell you this, but you should always keep your word no
matter what.

This was the first I have heard of this as well. As a matter of fact Betty blue nose re-assured me we were in the clear. Why is this coming up 3 weeks after the party.
You gotta love NHIS. It's great to see that Degsy is the one they put the blame one. It seems sometimes you just can't get a break.

It has come to my attention that fellow racers and families at NHIS during the June 7th, 8th LRRS race weekend had complained about the band playing past the 10:00 PM curfew. For this I would like to accept full responsibility and offer our sincerest apologies to those we may have caused grief. I can assure you the purpose of the party was to meet fellow racers and make new friends. We certainly did not want to upset the delicate relationship between the LRRS community and NHIS staff.
As you stated in an email to Derek Sinclair of NESR Racing. It is vitally important that when activities such as this have been approved that we as organizers keep such activities with in the allotted time and more importantly keep our word in fulfilling our duty to end the activity when promised to executive staff and organizers of the sanctioning body.
To offer and explanation as to why the band played late I can offer the following: The band did start a bit late due to the trophy ceremony running a bit longer than anticipated as well as having a small technical problem with power during the middle of the first set. I had initially asked the band to stop at 9:50 but the large crowd on hand had asked if they could play a few more songs. Unfortunately the band got caught up in the reaction of the crowd and what should have been 2 songs grew into 4 ending the show at 10:22 by my watch. Certainly there is no excuse for allowing the band to play past the 10:00 PM curfew but hopefully this explanation may help clarify the circumstances leading up to the emails and calls you may have personally received.
Again, I offer my deepest apologies to you and the rest of the racing community in LRRS that we at Double Apex Racing hold very dearly. I can only hope that we are given the opportunity at some point to demonstrate our willingness and ability to follow the rules of LRRS and NHIS. I look forward to expressing my apology in person at the next race weekend. Hopefully these actions will not exclude us from providing entertainment in the future.
If you would like to further discuss what actions or services we at Double Apex Racing can provide to make reparations, I am certainly open to ideas and more than willing to accommodate in any way mutually agreed upon.

1) Why so long to hear this? This happened weeks ago...
2) I thought they were done at 10:00. We live about 20 minutes from the track, and we were home at 11:00 on the dot. And we hung around for a bit after the second set...
3) Funny that no one had any complaints having to do with FREE beer. (That's not a poke at ya, Scotty. I'm serious)...
4) There were SEVERAL 'officials' from NHIS/LRRS there, pretty much the whole time. And they were very much enjoying themselves. If the 'curfew' was called into question, why didn't they pull Scotty aside and mention it?
5) Parents were getting upset? There were almost as many children there as were adults...

Okay. I've thought about this for a while now, and here is my ultimate response. I'm sure this may get a couple folks upset, particularly DART, but I can assure you that's not my intent...
We at NESR Racing were not aware of any curfew set forth by the officials of NHIS/LRRS, as we had nothing to do with the hiring or getting permission for the band. We simply provided FREE beer for EVERYONE that came by to take in some sounds that evening. Funny that the blame for the wrong doings automatically get placed in NESR Racing's lap. Astonishing that (to my knowledge) not many that were there offered a 'thank you' to us for the fact that we supplied half the infield with refreshments that night...
I'd argue that NESR Racing is one of the - if not THE - largest team there by virtue of it's core of volunteers and riders. Which would lead me to guess that given the amount of team members, fans, friends, family, and spectators that we may bring into the track each race weekend that we are responsible for significant revenue generation...
Every race weekend this year, NESR Racing has supplied the US Marshall service with corner workers. That's right: EVERY RACE WEEKEND THIS YEAR! And while it may seem like an insignificant gesture to some, all that have participated have donated their 'pay' to the Injured Riders Fund. In fact, NESR Racing has held several raffles these last two years to raise cash to donate to the fund...
This shouldn't be taken as a 'look at me! look at me!' stance. Rather, perhaps there was a better way to approach this situation even if NESR Racing WAS responsible for the band's over-run on time. There were a number of NHIS/LRRS officials at that tent the whole time, from beginning to end. I still don't understand why, if it was such a problem, one of them didn't say something to someone (again, keeping in mind the WE didn't hire the band or seek permission for them to play therefor were not aware of any time limitations). Rather, Derek gets a nasty email on NESR Racing's behalf telling us that WE almost got a police escort off the grounds. Everyone at NESR Racing has done nothing but try help out the race fraternity in several different ways, as we can all see. Surely there was a better approach to this than calling in the law or threatening to do so...
So here we are now. NESR Racing is on the LRRS/NHIS shit list now, so to speak. Even with all the effort we put into making this a safer and more fun environment for everyone, we have asked for nothing in return. No special mention, just some consideration for what we HAVE done...
From where I sit, this is a shitty deal for us in more ways than one. First off, NESR Racing STILL hasn't been exonerated from the situation with the band. Secondly, I honestly don't see us catching a break anytime soon with ANY situation that may arise now. But most importantly, I feel that the organization which we have tried to contribute to in many ways has let us down by placing the blame for this solely on us. Disappointed, frustrated, humiliated, and generally let down are the best descriptions of the way I feel now...

Jay your words are well said and as my letter has already gone out to Jerry, As a team owner responsible for the band I have tried to assume the roll as the "punishable" party.
As I stated in my letter to jerry I would like to discuss this with him in person.
Good move Scott. E-mails are e-mails, but nailing him down to give your side is gonna do more good than you may think and certainly clear the air (unless Jay is around farting).

The way I see it is: Permision was granted, entertainment was provided, money had been donated to a good cause. NESR was blamed because the banner was displayed behind the band. The parties who made the complaint assumed that NESR was responsible for the getting the band. Regardless of whether the band had played beyond the designated time allowed, there has been complaints made to Jerry in the past. This one was an easy mark, and it just happened to be a NESR\DART event. Had Jerry not taken so long with his bullshit after the races, maybe the band could have started on time. Scott I hope things work out with your one on one with Jerry. Two great teams trying to help the sport and they just get shitty end of the stick. that's just not right. I'm sure if this was something that NHIS had run would there be even an issue. I think not.
