We may have a line on a decent deal on a John Deere 4105 with a handful of attachments: backhoe, front bucket, winch, pallet forks & frame. It's only got about 500 hours on it, all by a home owner. He's going through a divorce and he'd like to keep it outta bankruptcy court and get the cash...
It's a 40.5HP, 4WD diesel w/ locking diff's, hydro tranny, blah-blah-blah. I don't wanna disclose what I think I can get it for, but I will say it's about the same as what we were planning to spend on a sub-compact Cub Cadet w/ backhoe & front bucket...
I'm wondering if anyone has any real world experience with these or is knowledgeable enough with tractors to tell me if it's a decent, solid machine (all things being equal). I'm NOT interested in any copy/paste jobs from internet sources - I've read enough of those these last coupla days...

I believe that was still small enough to have the yanmar engine, which was a good machine. Some of the other earlier 4000 series had slower hydraulics from my understanding, but over all reliable. Sorry couldn't be of better assistance. My last JD was a 2630.
Yip, the Yanmar. The hydros are run by 2 separate pumps, with almost 25GPM if I remember...

Old landlord had one. Make sure the backhoe is subframe mounted.
Also, have a tech check the 3pt hitch raising/lowering hydraulics. Those tend to need repair quite often on them, which is fairly pricey to have done. Not sure if it was based on year, but the one I shared a garage with had to have it repaired twice in the two years I lived there.

This is not intended as legal advice, nor should it be construed as such. It is merely my personal opinion of what I would be wary of if I were in your shoes looking to make this transaction. With that said, this guy already is involved in a divorce. The tractor is a marital asset and the divorce court has jurisdiction over all marital assets. He cannot sell without consent. If he’s withheld disclosure of it on his financial affidavit, that is fraud. If the other side finds out about it and makes the court aware, the transaction might be voided … especially if it is shown that the transaction was not an arm’s length transaction i.e., not made for the fair market value of the tractor. Also, he already represented to you he’s going to file bankruptcy. If he does subsequently file, the bankruptcy trustee can “claw back” any asset transaction made 90 days or in some instances 2 years prior to filing for bankruptcy if it is determined the transaction was a preferential transaction or made with the intent to defraud creditors (and that doesn’t mean a lien on the tractor, but all creditors of this guy). I would be very concerned that this transaction fits very neatly within those parameters. Oh, and the bankruptcy trustee doesn’t give you your money back if the transaction is voided and the asset clawed back into the bankruptcy estate … no, you get to step in line with all the other creditors this guy has…. If it were me, based on these facts on this big ticket item, I’d be really careful of deals that are too good to be true, because they usually are.
Just saying, my 2 cents, if it were me in your shoes....

Actually, THE ATTORNEY we'd be buying it from has already had his divorce finalized. Him keeping the tractor was part of the $4 MILLION settlement with his wife. He needs to come up with $50,000 before the end of the month to proceed with bankruptcy filings. I appreciate your concern, but I'm certain it'd be a safe transaction...
Among other things he's looking to sell ASAP is an early 90's (I think) 911 'Slat Nose' turbo (930?), a 2000-something 911 turbo (996?) and his $1.8 million dollar house sitting on 25 acres. Being one of Big Shirl's clients, you can assume we place some trust with him...

Stoneman, I think the issue specifically has to do with the draft control on the 3pt hitch....could be mistaken. Just something to ask about is all.

I've been working my 4410 (35hp) since spring and I'm pretty impressed with it. I did a bunch of research before settling on a Deere and had it narrowed down to a Kubota or Deere. A good deal came around and I snagged it. I've been pretty happy. The only real downfall I've seen is the brakes. They don't get used because of the hydrostatic drive so they have a tendency to stick when they are used.

Well, we missed our target just a bit and it's currently in bankruptcy. But the attorney's attorney indicated this may actually work in our advantage. Big Shirl & him've got a meeting with his attorney Thursday, so we'll find out what the scoop is. Fingers crossed...

None the less, it's now out of probate and has been cleared for sale. We're going to check it out Sunday & make an offer. What he's asking would be a good deal. What I'm offering would make it a great deal. Like I said, this one's about the same cost as the new sub-compact Cub's we were looking at. But this one has almost twice the HP and a coupla more attachments. It's definitely way more than we'll ever need, but if we can snag it for what we're offering I can't walk away...

good luck. I've been looking for a nice sub for a while, hard to find anything not beaten to death (overutilized) or not near new price.
That's what we like about this. Any used sub was almost as much as a new one. We're offering about the same as we'd pay for a new sub with just the bucket & backhoe. It's too big & all, but I guess in many ways we're better off getting too much rather than not enough - especially if he takes our offer!
Only downside is with new they're offering some crazy financing options on subs. With this we'll hafta dig into our equity line. Yeah, we've already looked for financing - no one wants to touch it for even close to the rate our equity line is (under 3%). But for a deal like this?

Soooo...turns out the 4105 is really a 990 (about the same specs though). It's in the '03-'05 range w/ 600 hours on it and it's impeccably kept, as in way underused. All the attachments are in great shape and super easy to switch around. The 10,000lb winch with 250' cable is the bomb! He wants about $5K more than I wanna give, but he said he'd throw in the tandem axle trailer too...
So to break it down:

I can resist everything but Pete's mom.
We're finding a lot of lightly used under 30HP tractors w/ loader bucket & backhoe in the $20K range, which is what we're offering even though this one's definitely a few rungs above those (40HP, 4x4, lots of attachments & trailer)...
He bought everything brandy-new so I'm guessing he's got at least $40K into it - maybe closer to $45K, not including the trailer. Some of those attachments are fookin' expensive (backhoe, winch)...
