Tell him to pound sand... he bought a used bike.
2003 ZX7R

My email reply to him ... I calmed down and tried to not bitch him out
"I do not understand what you are saying. You saw the fairing and windscreen yourself when you were here and it was in good condition, which is the reason why you bought the bike. The fairing stay was straight also because I had the fairing on before and I told you myself that the fairing held on the fairing stay no problem. My mother and grandfather were there and saw the fairings and windscreen themselves and they say they were fine when they left here. You must have sat on them or threw them inside your truck too hard because when they left here they were fine. I know the fairing and windscreen left here fine, anyways as said on the bill of sale, sold as is and for parts. How can you tell me NOw , after you paid and signed the bill of sale the fairing is bad? You were the one who took them out of the bag and saw them yourself. Truthfully it seems like you fixed the bike and got on it and found out how fast it was and crashed it and want me to pay for half of it. I know the bike left here fine."

No, in theory he can sue you for nondisclosure.... but it would never see a courtroom for something like a bike.... it woudn't be worth the court costs to either of you. Only way he'd sue you is if he was a rich punk that really wanted to pay all that money to make your life miserable.Originally posted by coolriderdude
hmm , so in theory he can sue me because I admitted that the bike has been down before? Sorry if I seem stupid, I'm not really good with legal stuff and that bill of sale was actually from a microsoft word bill of sale template , but I added the bike was down part.

He came, he saw, he bought it, he now owns it.

More like I'd beat the shit out of him .... he scribbled his address on the bill of sale .. I can't even read where he lives .... He knows where I am though cause he picked the bike up from here ...

a bit of advice, if you are to have any other communicatins with him, DO NOT make assumptioms / accusations like above. did it happen that way? prolly. but if you assume and accuse without fact to back it up, it is nothing but mere speculation and makes it appear as if you *might* be trying to cover something, and it might piss him off becuase your actully correct. just stick with the facts; "it was fine when it left my possession, and i have no way of commenting on what happened to it thereafter becuase it was out of my hands.

Thanks for the heads up though .. I'll keep that in mind if I talk to him again

I would not worry so much. First, if he is a kid, he is not going to be taking anyone to court any time soon. All that is, is an empty threat to pressure you into giving him some money... looks like it is almost working.
Now, if by the time you inspect the bike, buy it, take it home, unload it, and look at it for a day or so to finally notice that the windscreen is broken, he deserves having to replace them himself. If it was the wires behind the head light were fraied or something not easily seen, that may be a different story.
I am willing to bet that he droped it unloading it... if he brought it home in a truck.
Send him another copy of the "fine print" of the bill of sale he signed. Thats all, just send that along with a note like "read carefully" or something.
You are in the clear, the dude is obviously 5/8 to 3/4 stupid.
I know a little about everything, and alot about nothing.
I wouldn't even bother replying to him anymore. He's not going to do anything except whine like the little, punk-ass puke that he is. If you DO reply, something along the lines of "Suck my dick" should do nicely.![]()

If you're being honest here(and no reason you're not), and the damage he's claiming was there before wasn't, I think you're all set, no reason to flip out.
For one, if he picked up the bike at your house, he would have pointed out the damage at the time of delivery. I can't understand why he'd take it home, then complain after the fact? Like you said, he was holding the fairings.
In MA, motor vehicle lemon law is for mechanical, not for cosmetic damage. I don't think he'd have a leg to stand on if he sued you. It's obvious a crack in the fairing could have happened after he took it home.
I wouldn't tell him to pound sand yet. Just explain you agreed on a price, he saw the bike before taking it home, and if there was any problems with the cosmetics, it should have been negotiated at the time of sale, not after.

or the "FUCK YOU' route
You should also point out the fact that you sold him a 2500 dollar motorcycle for 1800 bucks.. there's the money for his god damn fairings.
That's what REALLY pisses me off... when someone finds a damn good deal then PISSES & MOANS that it's not in showroom friggin condition reguardless of whether or not they did the damage themselves.

Wait, so the kid saw the bike, saw the fairings, paid for the bike and fairings, took the bike and fairings home...and then suddenly "realized" that the fairings were rashed?
Please tell me there's more to the story than that, otherwise I've lost even more faith in humanity...
there was no rash on the front fairings but the rear right fairing had slight rash, i told him that before though, don't know why he is making such a big deal now ?Originally posted by Honclfibr

Or...try the FUCK YOU route.
I still don't understand how he's bitching after showing up, looking at the bike, then taking it home. I could understand if it was off ebay, and he didn't get a real look at it.
Just don't return his emails. You called him, if he wants to call you back he can. Plus Pete's right, if he did buy the bike really cheap he shouldn't be bitching over some rash.
