Re: Help Stop the Ban of Youth Motorcycles and ATVs!

It gets better -- turns out the powersports industry isn't the only one affected. The independent-testing requirements in this law make it effectively impossible to produce ANY products for children under 12. The Kneeslider has a good post about it with some very informative links:
    http://thekneeslider.com/archives/20...ooks-and-toys/

The practical real-world effect (due to the extensive third-party testing requirements) is basically that this law legislates all children's products out of existence. Truly, stunningly stupid.

Umm, got a responce from my Senitor and she said they are changing it so it is OK to have lead in places the kids can't access and also in things you cannot make at all without lead.... I'm not worried. it is just a huchup

    bullet point 3..

Accept a manufacturer’s determination that a lead-containing part on their product is inaccessible to a child and not subject to the new lead limits, if it is consistent with the Commission’s proposed guidance or is based on a reasonable reading of the inaccessibility requirement. Paint and other coatings or electroplating are not considered barriers that make a component inaccessible

So if I purchase the bike then it is not intended for my child and it is intended for me I should still be able to buy one right?

I've actually been wondering if the manufacturers could get around the law by marketing those bikes as pit bikes intended for adults.

Check the manufacturers' websites - the little bikes are not for sale. At least they weren't a few days ago.

I still cannot believe this has happened. If it doesn't get amended it will be a sad day for us all.

Very ambiguous, and it that is CPSC guidelines, not an amendment to the law.

Well, I don't profess to be a legal expert but I believe that the law is passed by senate and congress as initially written, so the law says something to the effect of "any toy or item designed for use by person under 12 containing lead paint". Then the CPSC say that under their guidelines they will be making a new rule that if the lead is not accessible to the little biter's teeth then they won't be reporting the item or seller. That doesn't change the law. That just changes the way the CPSC choose to enforce their procedures. That leaves people open to prosecution by law enforcement.

The only problem with that theory is that this was signed, sealed, and delivered in 2008, before the new administration. It just took effect in 2009.

It was overwhelmingly approved by both parties and signed by Pres. Bush last August. The CPSC approved the detailed implementation before the inauguration.

Maybe Obama's goverment is totally Gaea, but they didn't have anything to do with this particular fiasco.

Re: Help Stop the Ban of Youth Motorcycles and ATVs!

This is the reply I got today.

    Dear Mr. Boos:

Thank you for your letter on recent safety recalls of tainted food and consumer goods. I share your concerns and I appreciate this opportunity to respond.

It is the responsibility of the Food and Drug Administration to inspect and safeguard the nation's food supply, in order to prevent outbreaks of food-based illnesses and contain such outbreaks when they do occur.

To help the FDA accomplish these goals, the Senate has passed several measures to reinforce and improve the FDA, and I am proud to have been a sponsor of the FDA Revitalization Act, which strengthens the FDA's ability to inspect food and expand its notification process so that the public can learn sooner about outbreaks and recalls sooner.

Our people expect and deserve that their food supply and consumer products are safe. I strongly support the agencies responsible for inspecting food and goods, and when necessary, and I'm doing all I can to see that they have the authority and support they need to protect the American public.

Thank you for contacting me on this important subject.

    Sincerely,
    Edward M. Kennedy
Clearly this has fallen on deaf ears. Unless of course youth motorcycles are now considered a food product.

    Copied from the ARRA website:
    http://www.arra-access.com/campaign/adv_s608#

Senate Bill to Overturn Ban on Youth ATVs and Dirt Bikes Introduced!

Weigh in to Have Your Voice Heard!

Youth sized ATVs and dirt bikes are still banned. We need your help to continue to build enough pressure to get the ban overturned. It is unlikely that the Consumer Product Safety Commission (CPSC) will act to approve the Motorcycle Industry Council’s petition to grant regulatory relief. This means we need Congress to act.

Senator Tester (D-MT) has introduced legislation, S. 608 that would stop the ban. Please click the Send This Message button below to urge your Senators and Members of the Senate Commerce, Science and Transportation Committee to support this bill.

ARRA members have responded in huge numbers on this issue already, but it is important that you continue to have your voice heard.

After you weigh in, please use the Tell-A-Friend feature, located in the left tool bar, to forward this alert to everyone you know that rides. It is imperative that the voice of every rider be heard!
