It gets better -- turns out the powersports industry isn't the only one affected. The independent-testing requirements in this law make it effectively impossible to produce ANY products for children under 12. The Kneeslider has a good post about it with some very informative links:

The practical real-world effect (due to the extensive third-party testing requirements) is basically that this law legislates all children's products out of existence. Truly, stunningly stupid.

Umm, got a responce from my Senitor and she said they are changing it so it is OK to have lead in places the kids can't access and also in things you cannot make at all without lead.... I'm not worried. it is just a huchup

Well, I don't profess to be a legal expert but I believe that the law is passed by senate and congress as initially written, so the law says something to the effect of "any toy or item designed for use by person under 12 containing lead paint". Then the CPSC say that under their guidelines they will be making a new rule that if the lead is not accessible to the little biter's teeth then they won't be reporting the item or seller. That doesn't change the law. That just changes the way the CPSC choose to enforce their procedures. That leaves people open to prosecution by law enforcement.

The only problem with that theory is that this was signed, sealed, and delivered in 2008, before the new administration. It just took effect in 2009.
It was overwhelmingly approved by both parties and signed by Pres. Bush last August. The CPSC approved the detailed implementation before the inauguration.
Maybe Obama's goverment is totally Gaea, but they didn't have anything to do with this particular fiasco.

Youth sized ATVs and dirt bikes are still banned. We need your help to continue to build enough pressure to get the ban overturned. It is unlikely that the Consumer Product Safety Commission (CPSC) will act to approve the Motorcycle Industry Council’s petition to grant regulatory relief. This means we need Congress to act.
