This reminded me of something I've been noticing lately. A lot of cruiser riders don't seem to use the front brake at all. I have seen two, in the past two weeks alone, roll to a stop at a stop sign, using nothing but the rear brake at first, and then as they are almost stopped, they put both feet down and stop the bike with their FEET! This explains that funny little duck-walk thing you often see guys on cruisers doing at low speeds. Who taught these people how to ride?
Maybe all you read was the headline....
In actuality, the problem was that his rear brakes had not been reconnected by a shop that had changed his rear tire. When he came to a situation where he had to stop and he found he had no rear brakes he grabbed more front than he was used to and it sounds like the front wheel tucked...panic stop. The headline is the only place where it says anything about flipping so I'd say the moron is the editor/writer.
All those who have never tucked the front from too much front brake raise your hands...

So lemme get this straight, the rider has limited riding skills and is sueing because of it?
That shit ain't right.
So........
what would you people do if you picked up your bike form the shop EXPECTING everything to work correctly...........get into a situation where you had to use the rear brakes and find out that they don't work?
Some would grab more front, some may not, some may get into an accident, some may even lay it down.
Point being, the shop should have checked the brake system, to make sure it worked properly before, calling the job done.
So that being said, whether he flipped the bike or not, I think he has a legitimate claim.
What would you do if your car had work done and you had no brakes or something else that cause the car to work improperly?
So let's all just point fingers! It's much easier.

On the other hand, he appears to be trying to secure a nice retirement from this ...above and beyond actual costs incurred. I have mixed feelings about that kind of 'blood' money. And I don't really think there's enough information in the article to determine the degree of his suffering, etc. And penaltys for the dealer? For a bunch of folks that seem to believe that people should be held responsible for their actions you seem to be willing to give the shop a free skate....

There are many levels of incompetence being displayed, this we all agree on. Issue I have is, at no point in time did the customer need to use his brakes prior to the incident we're reading about? Obviously there was a breakdown in skillset at the shop itself but I'm wondering if this isn't an oppotunist-type lawsuit.
I believe the shop is at fault here, but I believe that some of the responsibility lies with the rider as well. This is just an extension of the safety warnings we need to have on every single product because some retard used it in a manner it wasnt designed for and sued and got money for it.
I'm positive it also says in his owners manual to check the brakes before every ride. I'm guessing he didnt follow instruction.

Does nobody check there bike before taking possession from a repair shop? If I have work done, I would check the bike over before accepting it OR paying for it.
YOU as a rider are responsible to do this BEFORE getting on a bike. It is just as much your responsibility as it is theirs!
